1. Introduction
Welcome to Pafety Technologies. These Terms of Service ("Terms") govern your access to and use of our platforms and services, including Pafety Events, Pafety Shule, Pafety GPS Tracking System, and Pafety Suite (ERP System).
By accessing or using our services, you agree to be legally bound by these Terms. If you do not agree, you must not use our services.
2. Services Provided
Pafety Technologies provides:
- Event management and digital invitation systems (Pafety Events)
- School management systems (Pafety Shule)
- GPS tracking and fleet management solutions
- Enterprise Resource Planning (ERP) solutions (Pafety Suite)
- ICT consultancy, system integration, and support services
3. Eligibility
You must be at least 18 years old or have legal authority to enter into agreements on behalf of an organization to use our services.
4. User Responsibilities
You agree to:
- Provide accurate, complete, and up-to-date information
- Maintain confidentiality of login credentials
- Ensure lawful use of all services
- Be responsible for all activities under your account
5. Data Accuracy and Usage
You are solely responsible for the accuracy of data entered into our systems. Pafety Technologies is not liable for decisions made based on incorrect or incomplete data.
6. GPS Tracking Disclaimer
Our GPS tracking services depend on third-party networks and hardware. We do not guarantee continuous availability or absolute accuracy. We are not liable for losses arising from inaccurate tracking data or downtime.
7. Service Level Agreement (SLA)
- Target system uptime: 99% monthly availability, excluding scheduled maintenance
- Scheduled maintenance will be communicated in advance where possible
- Support hours: 24 Hours
- Response time:
- Critical issues: within 4 hours
- Major issues: within 24 hours
- Minor issues: within 72 hours
No service credits are guaranteed unless agreed in a separate contract.
8. Payments, Invoicing, and Billing Enforcement
- Services may be billed on a subscription or usage basis
- Invoices must be paid within the agreed period (e.g., 7/14/30 days)
- Late payments may result in:
- Service suspension
- Additional penalty charges
- Continued non-payment may lead to permanent account termination and legal recovery actions
All fees are non-refundable unless otherwise agreed in writing.
9. Intellectual Property
All systems and content are the intellectual property of Pafety Technologies. Users receive a limited license to use the services.
10. Multi-Tenant ERP Data Ownership
- Each client retains ownership of their data within Pafety Suite (ERP) or Pafety Shule (School Management System)
- Pafety Technologies acts as a data processor
- Data is logically separated between clients
- Clients are responsible for data accuracy and legal compliance
We reserve the right to retain system-level metadata for analytics and system improvement.
11. Confidentiality
Both parties agree to maintain confidentiality of sensitive data.
12. Limitation of Liability
We are not liable for indirect damages, loss of profits, or service interruptions.
13. Indemnification
Users agree to indemnify Pafety Technologies against claims arising from misuse of services.
14. Termination
We may suspend or terminate services for violations, non-payment, or legal reasons.
15. Compliance with Laws
Users must comply with all applicable laws of Tanzania.
16. Changes to Terms
We may update these Terms at any time.
17. Governing Law
These Terms are governed by Tanzanian law.
